The agrees to supply a list of all Union Contractors to the Secretary of the JURISDICTIONAL DISPUTES (STIPULATED) When a work claim dispute arises between the Un- ion which is a Party to this Agreement and any other union, person or organization which cannot be set- tled to the satisfaction of all parties concerned, such a dispute shall not be the subject of a grievance un- der this Agreement, or the Ontario Labour Relations Act, but shall, without any stoppage of work or in- terference with the progress of the job, be proc- essed in accordance with the Plan for Settlement of Jurisdictional Disputes in the Construction Industry or to any similarly structured board, which may be established if the said Plan is not available to the parties. In the meantime, work will continue as assigned by the Employer until otherwise changed by decision of the Joint Board or the Ontario Labour Relations Board.

Each of the signatories hereto other than BALAH and BAII represents and warrants that (i) if it is a corporation or a sociedad anonima, it is duly organized, validly existing and in good standing in the jurisdiction of its incorporation, and, regardless of whether it is a corporation or a sociedad anonima, it has full power and authority to enter into this Agreement and to perform its obligations hereunder, (ii) the execution of this Agreement by it has been duly authorized by all necessary action, (iii) this Agreement constitutes its legal, valid and binding obligation, enforceable against it in accordance with the terms hereof, except as may be limited by bankruptcy, insolvency and the availability of equitable remedies, and (iv) the execution of this Agreement and performance of its obligations hereunder will not conflict with, or result in a breach of or default under, any agreement or instrument to which it is a party or by which it is bound, or any order, decree or judgment of any Governmental Entity.
OTHER SIGNATORIES. (A) No party to this Agreement shall sign a Labor Agreement with a non-party covering work within the jurisdiction of this Agreement which contains terms mate- rially different from this Agreement. If such an Agree- ment is signed, the other party to this Agreement shall have the right at its option to adopt any such other Agree- ment. It is understood that any National Maintenance or Project Agreement of the International Association of Bridge, Structural, Ornamental, and Reinforcing Iron Workers, which is beyond the control of the Union, would not be affected by this Agreement.
