Other Owners. Telephone companies that have joint ownership of Poles with Owner and/or those telephone companies that have authorized CL&P to license attachment of Facilities on such telephone companies’ Poles or jointly owned Poles.

Other Owners. Each OTHER OWNER is executing this Agreement for the express purpose of being bound by the provisions of Articles II (Warranties and Representations), IX (Trade Secrets and Trademarks), X (Unfair Competition and Covenant Not to Compete) and Subsections 13.7(a) (Survival of Obligation of Confidence) and 13.7(b) (Survival of Covenant Not to Compete) hereof.

XXXX acknowledges that City is not the owner of some underground facilities on, or contiguous to, the Project Site. “Underground facilities” includes, but is not limited to, electrical conduit, water irrigation canals and ditches, gas lines, telecommunications lines, or other communications fibers, and such facilities may be owned and/or operated by governmental or private entities;

Other Owners. With respect to any Property in which any tenants-in-common, joint venture partners or other third parties have an interest in the title to such Property, the applicable Seller of such Property agrees to use its best efforts to convey or have conveyed to Purchaser one hundred percent (100%) of the title to such Property. The tenants-in-common, joint venture partners or other third parties shall be entitled to receive their allocable share of the applicable Purchase Price for such Property as set forth on Exhibit N. In the event that any Seller is unable to convey to Purchaser 100% of the title to any Property, such Seller shall convey to Purchaser all of its interest in such Property and the applicable Purchase Price for such Property shall be reduced proportionately by the amount which such Seller's interest is less than 100%.
