Other Hazardous Materials. (a) To the extent that any materials which are Hazardous Materials (other than asbestos) on the date of this Lease are present in any of the Delivery Spaces on the applicable Space Delivery Date (other than Hazardous Materials which result from contamination caused by the introduction by Tenant of Hazardous Materials to portions of the Demised Premises then occupied by Tenant) and are required to be removed or remediated by any Legal Requirement applicable on the date of this Lease, then Tenant shall give prompt notice thereof to Landlord, and as Tenant's sole remedy, Landlord shall, at Landlord's sole cost and expense, remove or remediate such Hazardous Materials in compliance with applicable Legal Requirements.
Other Hazardous Materials. CONSULTANT shall also test for other hazardous materials when pertinent. These may include aerially deposited lead, asbestos- containing building materials, lead paint, metallic content of thermoplastic pavement markings and petroleum hydrocarbons. (See Task 3.5)
Other Hazardous Materials. South Hampton hereby represents, warrants and certifies to the best of its knowledge after all appropriate inquiry, that there are no underground storage tanks located on, under or about the Property that are subject to the notification requirements under Section 9002 of the Solid Waste Disposal Act, as now or hereafter amended (42 U.S.C.   • No Hazardous Materials (A) have been disposed of or otherwise released from any Real Property of the Company or any of its Subsidiaries in violation of any Environmental Laws; or

  • Hazardous Substance “Hazardous Substance” means any pollutant, contaminant, toxic substance, hazardous waste, hazardous material, hazardous substance, petroleum or petroleum product, asbestos, polychlorinated biphenyls, underground or aboveground storage tanks and the contents thereof including, without limitation, any such materials defined in or regulated pursuant to any Environmental Law.
