Other Due Diligence. Satisfactory completion of Bank’s due diligence, including satisfactory completion by Bank of a collateral field audit
Other Due Diligence. Prior to the Closing, and subject to the --------------------- terms and conditions of this Agreement, Buyer may conduct such other examination or investigation of public records relating to the Assets or third persons having knowledge of the Assets as Buyer may choose to conduct in its discretion.
Other Due Diligence. To the extent available and not otherwise delivered pursuant to items (a) through (e) above, those items contained on Schedule 4.1(e) of this Agreement. Seller’s failure to deliver to Purchaser items (a) through (e) above within ten (10) days after the Effective Date shall not result in the extension of the Approval Period, and Purchaser’s sole remedy therefor shall be Purchaser’s right to terminate this Agreement by delivering written notice thereof to Seller within twenty (20) days after the Effective Date hereof and receive a return of the Xxxxxxx Money, in which event neither party shall have any obligation hereunder except for the Surviving Obligations.
Other Due Diligence. The Lender, the Administrative Agent and the Depository Bank shall have completed all other applicable due diligence investigations of the Loan Parties in scope, and with results, satisfactory to the Lender, including: (i) organizational structure of the Loan Parties being satisfactory to the Lender, (ii) the structure of the transaction being satisfactory to Lender’s accountants in Lender’s sole discretion (including with respect to variable interest entity accounting issues), (iii) satisfactory review of liquidity analysis for Xxxxxxxxxxxx and the Loan Parties over the term of the Loan, and (iv) satisfactory review of the sources and uses of funds (including accommodation for future capital expenditures to the extent material).
Other Due Diligence. Prior to the Closing, and subject to the terms and conditions of this Agreement, HBS Bio may conduct such other examination or investigation of public records relating to the Subject Property or third persons having knowledge of the Subject Property as HBS Bio may choose to conduct in its discretion.

Other Due Diligence. Agent shall have received from the Credit Parties any other information or materials available as reasonably requested by Agent.

Mezzanine Lender shall have received any and all reports, investigations, documents, instruments, materials and other information on or relating to the Borrower or any other Loan Party, the Collateral Assets, the Mortgaged Properties and/or the Underlying Obligors reasonably required by Mezzanine Lender, including without limitation background checks, financial statements and UCC, judgment lien and bankruptcy searches with respect to the Loan Parties, REIT Holdings and CTLH, and all such reports, investigations, documents, instruments, materials and other information shall be satisfactory to Mezzanine Lender in its sole discretion.
Other Due Diligence. Prior to the Closing, and subject to the terms and conditions of this Agreement, Strike Axe may conduct such other examination or investigation of public records relating to the Assets or third persons having knowledge of the Assets as Strike Axe may choose to conduct in its discretion.
Other Due Diligence. The Agent shall have received evidence, to its reasonable satisfaction, that Loan Parties are materially in compliance with all pertinent Federal, State and local Laws including Environmental Laws, occupational safety and ERISA.
