Common use of Original Guaranty Clause in Contracts

Original Guaranty. Guarantor acknowledges that this Guaranty is given in substitution for, and amends, modifies and restates, and as amended, modified and restated, replaces the Original Guaranty. It is expressly understood and agreed that this Guaranty is given in replacement of the Original Guaranty, and that no obligations or liabilities evidenced by the Original Guaranty shall be discharged, cancelled or impaired by the execution and delivery of this Agreement. To the extent any of the terms of the Original Guaranty and this Guaranty conflict, the terms of this Guaranty will govern.
