OPERATIONS AND MAINTENANCE RESPONSIBILITY. 3.1. Within the Eldorado Substation Site, responsibility for the operations and maintenance of the Eldorado-Magnolia 230 kV line shall be as follows: 3.1.1. Operating Agent shall have sole operations and maintenance responsibility for the Connecting Facilities for the Eldorado- Magnolia 230 kV line from Eldorado Substation 220 kV Switchyard position No. 3 to the point where Eldorado-Magnolia 230 kV conductors connect to transmission structure No. X25961. 3.1.2. Connecting P articipant shall have sole operations and maintenance responsibility for the Connecting Facilities for the Eldorado- Magnolia 230 kV line from transmission structure No. X25967 up to, and including, transmission structure No. X25961. 3.2. Within the Eldorado Substation Site, responsibility for the operations and maintenance of the Eldorado-NSO 230 kV line shall be as follows: 3.2.1. Operating Agent shall have sole operations and maintenance responsibility for the Connecting Facilities for the Eldorado-NSO 230 kV line from the Eldorado Substation 220 kV Switchyard position No. 3 to the point where Eldorado-NSO 230 kV conductors connect to transmission structure No. X25962. 3.2.2. Connecting Participant shall have sole operations and maintenance responsibility for the Connecting Facilities for the Eldorado- Magnolia 230 kV line from transmission structure No. X25968 up ' to, and including, transmission structure No. X25962.
OPERATIONS AND MAINTENANCE RESPONSIBILITY. (a) DNB shall be responsible for the operation and maintenance of its own Network, Facilities and Services, including any co-location facilities owned and operated by or for DNB (Co-Location Facility). (b) The Access Seeker shall be responsible for the operation and maintenance of its own Network, Facilities and services, and any of its Equipment at any Co- Location Facility. (c) If the Access Seeker co-locates at a Co-Location Facility, the Access Seeker must (at its own cost): keep its assigned area of the Co-Location Facility in a tidy and safe condition; ensure that all Personnel deployed at a Co-Location Facility: (i) are adequately trained, qualified, competent and properly certified in all environmental, safety, and health standards; and (ii) meet the requirements of any applicable Laws; ensure that any hazardous or combustible material is not left in or around the Co-Location Facility, except as agreed between the parties and provided the Access Seeker complies with any safety and operational controls established by DNB; and take such other action as a prudent operator of such Co-Location Facility and Equipment would take in the circumstances in respect of its assigned area of the Co-Location Facility.

This responsibility extends to all phases of the Project, including but not limited to installation, commissioning, testing, and operational use. The CITY OF MOORPARK shall perform all O&M activities in accordance with the manufacturer’s recommendations, industry best practices, and all applicable laws and regulations.
