Operation of Software. Concessionaire shall ensure that it operates on at least 1 (one) of the computer system at the District Hospital software pertaining to state wide management information system; [HMIS, e-Mamta, SNCU software, e-Aushidhi, UDID etc.] as may be notified by the Authority from time to time. The Concessionaire shall bear all costs in connection with purchase, royalty, if any, renewal etc. of the software mentioned in this Clause 23.9.

ZDNet understands that the Campaign Manager may communicate certain information about the use of the Campaign Manager for delivery and redemption of ZDNet Offers back to e-centives' servers, and ZDNet consents to such communications. All data transmitted to e-centive's servers regarding ZDNet Offers shall be owned exclusively by ZDNet and e-centives shall not use any such data to any third party nor use it for any purpose other than the performance of its obligations hereunder.

ITA will be responsible for all aspects of the operation of the Licensed Software on behalf of Galileo, including the installation of Upgrade Releases provided under the License Agreement. ITA will also monitor the Licensed Software at the Data Center. ITA will not be responsible for Galileo’s operation of Galileo’s web site or for the operation of any software or hardware which is not located at the Data Center.

Vendor represents and warrants to Insurint that, for a period of 12 months after acceptance (the “Software Warranty Period”), the Software shall not contain any Nonconformities. If Insurint, within the Software Warranty Period, notifies Vendor of any breach of the foregoing warranty, Vendor shall use commercially reasonable efforts to correct the Nonconformity. If Vendor is unable to correct the Nonconformity within 30 calendar days, Vendor shall, if so requested by Insurint, promptly refund to HBDC the License Fees (or refund to Insurint a portion of the fees for Maintenance Services, if the Nonconformity is related to an Update) paid by HBDC for the defective Software.

ITA will be responsible for all aspects of the operation of the ITA Software and Licensed Data in order to provide services to Kayak, including the installation of Corrections and Improvements. ITA will also monitor the ITA Software at the Data Center. ITA will not be responsible for Kayak’s (or any Online User’s) operation or use of the Site or for the operation of any software or hardware which is not located at the Data Center. ITA will provide by email to ixx@xxxxx.xxx. on a daily basis, a histogram of server utilization, and a graph that shows the number of Queries per minute throughout the day. In the event ITA develops other reports to be provided regularly to its customers, it will provide such reports to Kayak as well. ITA will also make available to Kayak, upon Kayak’s request, query logs showing Kayak’s Queries to the ITA Software.
Operation of Software. Licensor does not warrant that the operation of the Software or the operation of the Software Products will be uninterrupted or error free. Licensor further warrants that software will be functional greater than 98.0% of the time.
