Open for Business. The Concession Space shall be deemed open for business when Concessionaire has (i) delivered documentation satisfactory to the City of completion of construction of the Concession Space; (ii) obtained written permission from the Manager’s authorized representative to and thereafter removed the construction wall surrounding the Concession Space and (iii) commenced generating sales and revenue from the Concession Space. The date Concessionaire actually opens for business will be confirmed by the Parties and documented on Exhibit D1.
