of Section 4.03. The Administrative Agent shall have received (i) copies of the Partnership Agreement (MLP), the Series 2010A Indenture, the Series 2010B Indenture and the Partnership Agreement (Borrower) and (ii) a certification by the Borrower that the Partnership Agreement (Borrower), the Series 2010A Indenture, the Series 2010B Indenture and the Partnership Agreement (MLP) are in full force and effect and have not been amended or modified except to the extent such amendments or modifications have been delivered to the Administrative Agent, which evidence may be in the form of a certificate of the President or a Vice President (or equivalent officer) of each of the Borrower and the MLP.
