Common use of Obligation to Procure Clause in Contracts

Obligation to Procure. The Buyer’s obligations under clause 3.3(a), clause 3.6(c) or clause 6 to procure that the Operator shall perform certain acts shall only apply to the extent that the Operator is a Related Body Corporate of the Buyer. If the Operator is a Related Body Corporate of the Seller, or any Seller Group Member, the Seller shall be obliged to procure such performance in favour of the Buyer and the relevant clause shall apply mutatis mutandis.

Obligation to Procure. The Buyer’s obligations under clause 3.3(a3.4(a), clause 3.6(c) or clause 6 8 to procure that the Operator shall perform certain acts in favour of the Seller shall only apply to the extent that the Operator is a Related Body Corporate of the Buyer. If the Operator is a Related Body Corporate of the Seller, or any Seller Group Member, the Seller shall be obliged to procure such performance in favour of the Buyer and the relevant clause shall apply mutatis mutandis.
