Obligation to pay costs. A Luxembourg court may refuse to give effect to a purported contractual obligation to pay costs imposed upon another party in respect of the costs of any unsuccessful litigation brought against that party before a Luxembourg court. A Luxembourg court may not award by way of costs all of the expenditures incurred by a successful litigant in proceedings brought before a Luxembourg court.

Obligation to pay costs. In either case, the losing Party shall pay all court costs, reasonable attorney fees, travel, lodging and any other costs in connection with any dispute.
Obligation to pay costs. If either party seeks to enforce the terms of this Agreement by filing a lawsuit, the prevailing party shall be entitled to recover, as part of the judgment, all costs and expenses incurred as a consequence of that lawsuit, including reasonable attorneys’ fees incurred in pursuing or defending same.

  • Payment of Reimbursement Obligations (a) The Borrower agrees to pay to the Administrative Agent for the account of the Issuing Bank the amount of all Advances for Reimbursement Obligations, interest and other amounts payable to the Issuing Bank under or in connection with any Facility Letter of Credit when due, irrespective of any claim, set-off, defense or other right which the Borrower may have at any time against any Issuing Bank or any other Person, under all circumstances, including without limitation any of the following circumstances:
