Common use of Obligation to Evolve Clause in Contracts

Obligation to Evolve. Service Provider acknowledges and agrees that its current technologies and processes shall continue to evolve and change over time, and at a minimum, shall remain consistent with the best practices of first tier providers of services that are the same as or substantially similar to the Services, with such evolutionary changes to be implemented in a manner consistent with the objectives and needs of DIR and the DIR Customers. Subject to Sections 9.5 and 9.6, Service Provider shall provide the Services using current technologies and processes that shall enable DIR and the DIR Customers to take advantage of advances in the industry.
