NOW THEREFORE IT. IS ENACTED as a by-law of the Corporation of the City of Windsor (herein called the “Employer“) as follows: The Employer hereby elects to participate in the Ontario Municipal Employees Retirement System on the day of January, (herein called “the effective date”) and authorizes the City Clerk to submit this election in writing (by provision of a certified copy of this by-law) to the Secretary-Treasurerof the Ontario Municipal Employees Retirement Board. Every employee who, before the effective date, was an employee of the Employer is entitled to become a member of the System if he is employed on a continuous full time basis, and at least seventy-five percent (75%) of the employees so employed become members. Every person who becomes an Employee of the Employer on or after the effective date shall, as a condition of his employment become a member of the System on the completion of not less than three (3) and not more than twelve (12) months of service on a full-time basis, provided however, that if he is already a member of the System then contributions by and on his behalf may, on the election of the employee, commence on any date during the first three (3) months of his service. The Commissioner of Finance of the Corporation of the City of Windsor is hereby authorized to arrange for the deduction from the earnings of each employee who is a member of the System, the contributions required to be made by the member, and to remit such contributions together with the amounts required under the Act to be paid by the Employer, to the Secretary-Treasurer of the Ontario Municipal Employees Retirement Board, and to execute all necessary documents and to do such things as are necessary to carry out the intent of this by-law. The Employer hereby elects to participatetogether with the Board of Commissioners of Police for the City of Windsor as a single Employer under the Ontario Municipal Employees Retirement System Act, and the Regulationsthereunder. This by-law shall come into force and take effect on the day of the final passing thereof.
