Novartis Transfer Sample Clauses

Novartis Transfer. If Novartis Assigns, or otherwise transfers any aspect of the manufacturing of the Product to a third party pursuant to Article 11 or as otherwise permitted under Section 14.3 but, for the avoidance of doubt not including Section 2.1, Novartis shall ensure that such third party is contractually obligated to honor BMTI’s rights and Novartis’ obligations with respect to those aspects of manufacturing so assigned. Any reference to BMTI rights or Novartis obligations set forth herein with respect to the manufacturing of the Product (including, but not limited to, the rights and obligations set forth in Article 6 relating to quality and regulatory matters) shall extend to any such Assignee of Novartis. ** REPRESENTS MATERIAL WHICH HAS BEEN REDACTED AND SEPARATELY FILED WITH THE SECURITIES AND EXCHANGE COMMISSION PURSUANT TO A REQUEST FOR CONFIDENTIAL TREATMENT PURSUANT TO RULE 406 UNDER THE SECURITIES ACT OF 1933, AS AMENDED.
