Common use of Notice to Lessor Clause in Contracts

Notice to Lessor. If Tenant shall mortgage Tenant’s interest in one or more Leased Properties to a Lending Institution in accordance with the terms of this Lease, and if the holder of the Leasehold Mortgage shall provide Lessor with a true copy of the Leasehold Mortgage and the name and address of the Leasehold Mortgagee (as hereinafter defined) and Lessor shall approve the Leasehold Mortgage, Lessor and Tenant agree that the provisions of this Section shall apply in respect to the Leasehold Mortgage. Lessor has heretofore approved the Leasehold Mortgages securing the Tenant Credit Agreement, provided that such approval shall not constitute an agreement by Lessor to be bound by the terms of any such Leasehold Mortgage. In the event of any assignment of a Leasehold Mortgage or in the event of a change of address of a Leasehold Mortgagee or of an assignee of a Leasehold Mortgage, notice of the new name and address shall be provided to Lessor.

Notice to Lessor. If Tenant shall mortgage Tenant’s 's ---------------- interest in one or more Leased Properties to a Lending Institution in accordance with the terms of this Lease, and if the holder of the Leasehold Mortgage shall provide Lessor with a true copy of the Leasehold Mortgage and the name and address of the Leasehold Mortgagee (as hereinafter defined) and Lessor shall approve the Leasehold Mortgage, Lessor and Tenant agree that the provisions of this Section shall apply in respect to the Leasehold Mortgage. Lessor has heretofore approved hereby approves of the standard Leasehold Mortgages securing Mortgage form draft that was forwarded to Lessor's counsel on February 28, 2001 and that is intended to be used in connection with the Tenant Credit AgreementSenior Secured Notes and further agrees that it would approve the same form for use in connection with the Exit Financing; provided, provided however, that such approval shall not constitute an agreement by Lessor to be bound by the terms of any such Leasehold Mortgage. In the event of any assignment of a Leasehold Mortgage or in the event of a change of address of a Leasehold Mortgagee or of an assignee of a Leasehold Mortgage, notice of the new name and address shall be provided to Lessor.

In the event of any assignment of a Leasehold Mortgage leasehold or in the event of a change of address of a Leasehold Mortgagee or of an assignee of a the Leasehold Mortgage, notice of the new name and address shall be provided to Lessor.
