Notice of Intent to Return from Leave. The unit member shall give written notice to the District of the unit member’s intention to return to duties by March 1 of the year in which the leave expires; otherwise, it will be assumed that the unit member does not intend to return.

Employees on leave must give the Superintendent written notice of intent to return according to the timelines specified for such leave in the contract, or if not specified in the contract, according to the letter from the Superintendent authorizing such leave. Failure to provide such notice as required in this contract shall terminate the employee’s reinstatement rights to the extent permitted under the Michigan Teacher Tenure Act.

Any unit member who is absent on assault leave, sabbatical leave, child care leave, general leave, or family and medical leave which expires with the beginning of a school year must notify the Superintendent of his/her intention to return from leave by March 15 preceding his/her scheduled return to duty. In all instances where a leave has been granted under this Article, and as a condition thereof, a teacher is required to advise the Superintendent no later than thirty (30) days prior to the return date, unless otherwise specified, that he/she intends to return to employment upon termination of the leave, failure by the teacher to provide such notice by the specified date shall constitute the teacher’s resignation as an employee of the School District.

For any Professional Staff who is on long term leave from the District, (FMLA, Childrearing, Sabbatical or other,) he/she shall give written notice by March 1st of his/her intention to return to work the next school year. Failure to give such notice by March 1st shall be deemed to be a statement that the Professional Staff does not intend to return from leave, and the School District may consider the position to be vacant.
