Common use of Notice of Extension Clause in Contracts

Notice of Extension. (a) If the Institutional Trustee is the only registered Holder at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Trustee and the Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Trustee is the only registered Holder of the Debentures at the time the Company selects an Extended Interest Payment Extension Period, the Company shall give written notice to the Regular Trustees, the Institutional Trustee and the Trustee of its selection of such Extended Interest Payment Extension Period at least one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder of the Subordinated Debentures at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Property Trustee and the Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, date or the date such Distributions are payable, payable to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder holder of the Debentures at the time the Company selects elects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Trustee Administrative Trustees and the Property Trustee of its selection election of such Extended Interest Payment Period at least one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or any other applicable self-regulatory organization or to holders of the Trust Preferred Securities issued by the TrustSecurities, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder holder of the Debentures at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to the Regular Administrative Trustees, the Institutional Property Trustee and the Trustee of its selection of such Extended Interest Payment Period one Business Day before on the earlier of (i) ten days prior to the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is or the Administrative Trustees are required to give notice of the record date, or the payment date for such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Capital Securities issued by the Trust, but in any event at least one Business Day ten days before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder of the Notes at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to both the Regular Trustees, the Institutional Trustee Trustees and the Property Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, date or the date such Distributions are payable, payable to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Capital Securities issued by the Trust, but in any event at least one Business Day before such record date.

(a) If the Institutional Property Trustee is the only registered Holder of the Subordinated Debentures at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Property Trustee and the Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (ia) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (iib) the date the Trust is required to give notice of the record date, date or the date such Distributions are payable, payable to the New York Stock Exchange or other applicable self-self- regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder holder of the Debentures at the time the Company selects an Extended Interest Payment Extension Period, the Company shall give written notice to the Regular Administrative Trustees, the Institutional Property Trustee and the Trustee of its selection of such Extended Interest Payment Extension Period one two Business Day Days before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, ; or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to The Nasdaq Stock Market's National Market, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder of the Debentures at the time the Company selects an Extended Interest Payment Extension Period, the Company shall give written notice to the Regular Trustees, the Institutional Property Trustee and the Trustee of its selection of such Extended Interest Payment Extension Period one Business Day before on the earlier of (i) 10 Business Days prior to the next succeeding date on which Distributions on the Trust Capital Securities issued by the Trust are payable, or (ii) the date the Trust is Regular Trustees are required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Capital Securities issued by the Trust, but in any event at least one Business Day before such record date.
