Common use of Notice of Completion Clause in Contracts

Notice of Completion. COPY OF "AS BUILT" PLANS. Within ten (10) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of Los Angeles in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord, after providing Tenant with two (2) days notice, may execute and file the same on behalf of Tenant as Tenant's agent for such purpose, at Tenant's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the "record-set" of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of sepias of such as-built drawings within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within ten (10) business days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of Los Angeles county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord, after providing Tenant with two (2) days notice, Landlord may execute and file the same on behalf of Tenant as Tenant's agent for such purpose, at Tenant's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Construction Drawings as necessary to reflect all changes made to the Approved Working Construction Drawings during the course of construction, (B) to certify to the best of their knowledge that the "record-set" of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of sepias copies of such as-built record set of drawings within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.. If Tenant fails to do so, Landlord, after providing Tenant with two (2) days notice, Landlord may execute and file the same on behalf of Tenant as Tenant's agent for such purpose, at Tenant's sole cost and expense. If Tenant Lessee fails to do so, Landlord, after providing Tenant with two (2) days notice, Lessor may execute and file the same on behalf of Tenant Lessee as TenantLessee's agent for such purpose, at TenantLessee's sole cost and expense. At the conclusion of construction, (i) Tenant Lessee shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the "record-set" of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord Lessor two (2) sets of sepias copies of such as-built drawings within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant Lessee shall deliver to Landlord Lessor a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

If Tenant fails to do so, Landlord, after providing Tenant with two (2) days notice, Landlord may execute and file the same on behalf of Tenant as Tenant's agent for such purpose, at Tenant's sole cost and expense. Within ten (10) days after completion of construction of the Tenant Improvements, Tenant Subtenant shall cause a Notice of Completion to be recorded in the office Office of the Recorder of the County of Los Angeles in accordance with Section 3093 of the California Civil Code of the State of California ss. 3093 or any successor statute, and shall furnish a copy thereof to Sublandlord and Landlord upon such recordation. If Tenant Subtenant fails to do so, LandlordSublandlord and/or Landlord may, after providing Tenant with two (2) days notice, may itself/themselves execute and file the same on behalf of Tenant Subtenant as TenantSubtenant's agent for such purpose, at TenantSubtenant's sole cost and expense. At the conclusion of construction, (i) Tenant Subtenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify that, to the best of their knowledge that knowledge, the "record-set" of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Sublease and the New Lease, and (C) to deliver to Sublandlord and Landlord two (2) sets of sepias copies of such asrecord set of drawings on auto-built drawings cadd within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within ten (10) days after completion of construction of the Second Amendment Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of Los Angeles county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord, after providing Tenant with two (2) days notice, Landlord may execute and file the same on behalf of Tenant as Tenant's agent for such purpose, at Tenant's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the "record-set" of as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two four (24) sets of sepias copies of such as-built record set of drawings within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.
