Nothing in clause 16. 5 shall prevent or prohibit The Supplier from, nor shall The Supplier be in breach of any provision of this Agreement in:
Nothing in clause 16. 1(a) prevents ARTC from entering into any sub- contracting or agency agreements or arrangements in relation to any of its functions.
Nothing in clause 16. 2.1 shall require the Provider to return or destroy any documents and materials containing or based on the Confidential Information that the Provider is required to retain by applicable law, or to satisfy the requirements of a regulatory authority or body of competent jurisdiction or the rules of any listing authority or stock exchange, to which it is subject. The provisions of the Agreement shall continue to apply to any documents and materials retained by the Provider pursuant to this clause 16.2.6.
Nothing in clause 16. 1(c) or clause 16.3 obliges the Affected Party to settle any strike, lockout, ban, limitation of work or other industrial dispute.
Nothing in clause 16. 2 shall prohibit the Seller or any member of the Seller’s Group from holding any interest in any securities listed or dealt in on any securities exchange or market if the Seller and any member of the Seller's Group are together interested in securities which amount to less than 3 (three) per cent of the issued securities of that class and which in all circumstances carry less than 3 (three) per cent of the voting rights (if any) attaching to the issued securities of that class, and if neither the Seller nor any member of the Seller's Group is involved in the management of the business of the issuer of the securities or any subsidiary undertaking of that issuer except by virtue of the exercise of any voting rights attaching to the securities.
Nothing in clause 16. 1 shall restrict the Purchaser or any Group Company together with the Purchaser from (i) informing landlords, customers or suppliers of the fact of (but not any term of) the acquisition of the Group Companies by the Purchaser; or (ii) complying with any notification provision under contracts with landlords, customers or suppliers, in each case after Completion.
Nothing in clause 16. 1 shall prohibit the placing of a public advertisement for any post if the advertisement is not specifically targeted at any Employee, nor shall it prohibit the employment of any Employee who applies for a post so advertised.
Nothing in clause 16. 1 shall preclude the Executive from holding (directly or through nominees) investments in the amount and of the type specified in Clause 11.3.
Nothing in clause 16. 4 shall entitle Party A to be appointed as the agent of, or otherwise act in the name of, Party B or to communicate with any third party in relation to the Indemnified Matter.
Nothing in clause 16. 1 of this Agreement shall affect the liability of any party in respect of any misrepresentation, warranty or condition that it makes fraudulently.
