NON-RECURRING ENGINEERING CHARGES. 8.1 EXABYTE and ESGW will mutually agree upon in writing ESGW provided non-recurring engineering charges and set-up fees (“NRE”) required to manufacture the Products. NRE charges will be billed to EXABYTE as mutually agreed upon in writing.
NON-RECURRING ENGINEERING CHARGES. In connection with the design, engineering, and development of the initial versions of the Products, EZEM shall pay VTAL a total of $______ as a non-recurring engineering charge. Such payments shall be made in accordance with the following schedule:
(a) $_______ shall be due upon the execution of this Agreement;
(b) $______ shall be due upon completion of an internal “Letter to File” by VTAL (following FDA Guidance Document - January 10, 1997, “Deciding when to Submit a 510(k) for a Change to an Existing Device”), or a Premarket Notification 510(k) submission to the FDA for the Appliance, whichever is deemed appropriate by VTAL; and
(c) $______ shall be due on the Appliance Commercial Availability Date. The parties agree and acknowledge that all Intellectual Property developed by VTAL, whether existing as of the date of this Agreement or developed hereafter, shall remain its sole and exclusive property notwithstanding the payment of such non-recurring engineering charge.
NON-RECURRING ENGINEERING CHARGES. 7.1 Customer and SCI will mutually agree on SCI provided non-recurring engineering charges and set-up fees ("NRE") required to manufacture the Products. NRE charges will be billed to Customer as mutually agreed upon.
NON-RECURRING ENGINEERING CHARGES. 8.1 A Non Recurring Engineering Charge of not more than $30,000, subject to review when custom specifications are complete, shall be charged to adapt the Product to Buyer's requirements and support testing and production startup. Connected Systems will also provide system integration support of Buyer's porting efforts. NON-RECURRING ENGINEERING CHARGES. NRE charges will be incurred and invoiced as set forth in VENUSA’s bid letter and as amended from time to time as mutually agreed, upon scope of work changes.

NON-RECURRING ENGINEERING CHARGES. 9.1 On a first time build of new products, U.S. Assemblies will not charge OpenROUTE for NRE costs associated with pick and place machine programming, original documentation packages and solder paste stencils. In subsequent engineering revisions requiring a new solder stencil, the cost will be charged to OpenROUTE, after a formal quotation is provided. In no instance will machine programming or documentation charges be passed on to OpenROUTE. All other NRE charges, such as test fixtures and programs, etc. will be quoted and charged to OpenROUTE per standard terms and conditions.
NON-RECURRING ENGINEERING CHARGES. 12.1 NEXUS and AMS will mutually agree on AMS provided non-recurring engineering charges and set-up fees (“NRE”) required to manufacture the Products. NRE charges will be billed to NEXUS as mutually agreed upon.
