Non-Recourse/Limited Liability. (a) Any other provision of this Agreement, the Note or the Mortgage seemingly to the contrary notwithstanding, it is understood and agreed that, except as provided in this Section 8.16, the Property shall be the sole recourse of Lender in the event of an Event of Default and that the liability of Borrower (and, if Borrower is a partnership, its partners) for any amounts due under this Agreement, the Note and/or under the Mortgage is limited to the interest of Borrower or its partners in the Property.

Non-Recourse/Limited Liability. Notwithstanding any other provision of this Agreement, the obligations of the City hereunder and with respect to the provision of the Project shall not be payable from any money or other property of the City except from Available Funds and any such obligations of the City shall be satisfied entirely from those sources and any money or other property provided by the Construction Agent for that purpose, and the City is not obligated to use any money or assets (other than Available Funds) in connection with this Agreement or to satisfy any duties, obligations, requirements or liabilities arising hereunder including the failure to perform any duty, obligation or agreement and any liability arising therefrom.
