Non-Cumulative. The parties agree and understand that the amounts set forth under this section for liquidated damages are not cumulative with one another. The amount set forth as liquidated damages for Contractor’s failure to achieve Substantial Completion shall be assessed upon default and continue until Substantial Completion is attained. The amount set forth as liquidated damages for Contractor’s failure to achieve Final Completion and readiness for payment shall be assessed after Substantial Completion is attained and apply until Final Completion is attained.
Non-Cumulative. Allowable leave shall not be accumulated from year to year.
Non-Cumulative. Dividends on shares of Designated Preferred Stock shall be non-cumulative. If the Board of Directors or any duly authorized committee of the Board of Directors does not declare a dividend on the Designated Preferred Stock in respect of any Dividend Period:

Non-Cumulative. All yearly vacation hours must be completed prior to December 31st of each year, except up to 240 hours of vacation leave carryover and when special situations are presented which permit carry over, with approval of the Business Administrator or Designee.
