Common use of Non-Conforming Measures Clause in Contracts

Non-Conforming Measures. 1. Articles 9.3, 9.4, 9.5 and 9.6 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 9.3, 9.4, 9.5 or 9.6.

Non-Conforming Measures. 1. Articles 9.3, 9.4, 9.5 and 9.6 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 9.3, 9.4, 9.5 or 9.6. 2. Articles 9.3, 9.4, 9.5 and 9.6 do not apply to any measure that a Party adopts or maintains with respect to sectors, sub-sectors, or activities as set out in its Schedule to Annex II.

Non-Conforming Measures. 1. Articles 9.38.3, 9.48.4, 9.5 8.5, and 9.6 8.6 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I8A; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I8A; orand (iii) a local government level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 9.38.3, 9.48.4, 9.5 8.5, and 8.6. 2. Articles 8.3, 8.4, 8.5, and 8.6 do not apply to any measure that a Party adopts or 9.6.maintains with respect to sectors, sub-sectors or activities as set out in its Schedule to Annex 8B.

Non-Conforming Measures. 1. Articles 9.311.2, 9.411.3, 9.5 11.4, and 9.6 11.5 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I; (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 9.311.2, 9.411.3, 9.5 11.4, or 9.611.5. 2. Articles 11.2, 11.3, 11.4, and 11.5 do not apply to any measure that a Party adopts or maintains with respect to sectors, sub-sectors, or activities as set out in its Schedule to Annex II.

Articles 9.311.2, 9.411.3, 9.5 11.4, and 9.6 11.5 do not apply to: (a) any existing non-conforming measure that is maintained by a Party at: (i) the central level of government, as set out by that Party in its Schedule to Annex I;, (ii) a regional level of government, as set out by that Party in its Schedule to Annex I; , or (iii) a local level of government; (b) the continuation or prompt renewal of any non-conforming measure referred to in subparagraph (a); or (c) an amendment to any non-conforming measure referred to in subparagraph (a) to the extent that the amendment does not decrease the conformity of the measure, as it existed immediately before the amendment, with Articles 9.311.2, 9.411.3 , 9.5 11.4, or 9.611.5. 2. Articles 11.2, 11.3, 11.4, and 11.5 do not apply to any measure that a Party adopts or maintains with respect to sectors, sub-sectors, or activities, as set out in its Schedule to Annex II. 3. Annex 11.6 sets out specific commitments by the Parties.

Articles 10.2, 10.3, 10.4, and 10.5 do not apply to any measure that a Party adopts or maintains with respect to sectors, sub-sectors, or activities as set out in its Schedule to Annex II. 3. Annex 10-A sets out specific commitments by the Parties.

Articles 10.2, 10.3, 10.4, and 10.5 do not apply to any measure that a Party adopts or maintains with respect to sectors, sub-sectors, or activities as set out in its Schedule to Annex II. (10-1) This paragraph does not cover measures of a Party which limit inputs for the supply of services.

Articles 8.3, 8.4, 8.5, and 8.6 do not apply to any measure that a Party adopts or 9.6.maintains with respect to sectors, sub- sectors or activities as set out in its Schedule to Annex 8B.
