NOMINATION CRITERIA. Only a person who is living with a mental illness or mental disorder can have a Nominated Person under the Mental Health Act 2015. The person needs to have the capacity to make that decision at the time of making the appointment. A Nominated Person must be an adult who is readily available, is able to fulfil the functions of the role and has agreed to be a Nominated Person (s. 19(2) of the Mental Health Act 2015).
