No Waiver by the Lender. Neither the extension of time for making any payment which is due and payable under this Note at any time or times, nor the failure, delay, or omission of the Lender to exercise or enforce any of its rights or remedies under this Note, shall constitute a waiver by the Lender of its right to enforce any such rights and remedies subsequently. The single or partial exercise of any such right or remedy shall not preclude the Lender’s further exercise of such right or remedy or any other right or remedy.

No Waiver by the Lender. The Lender's failure to exercise any right, remedy or option under this Agreement or any supplement or other agreement between the Lender and the Borrower or delay by the Lender in exercising the same will not operate as a waiver. No waiver by the Lender will be effective unless in writing and then only to the extent stated. No waiver by the Lender shall affect its right to require strict performance of this Agreement. The Lender's rights and remedies will be cumulative and not exclusive.
No Waiver by the Lender. Except as otherwise expressly provided for herein, nothing in this Agreement shall extend to or affect in any way any of the Obligors’ obligations or the Lender’s rights and remedies arising under the Credit Agreement or the other Loan Documents, and the Lender shall not be deemed to have waived any of its remedies with respect to any Event of Default.

None of the undertakings, agreements, warranties, covenants and representations of the Borrower contained in this Agreement or any of the other Loan Documents and no Event of Default by the Borrower under this Agreement and no defaults by the Borrower under any of the other Loan Documents shall be deemed to have been suspended or waived by the Lender unless such suspension or waiver is by an instrument in writing signed by an officer of the Lender and directed to the Borrower specifying such suspension or waiver.
No Waiver by the Lender. The failure of the Lender to exercise ----------------------- any right or remedy or option provided for herein or under applicable law shall not be deemed to be a waiver of any of the covenants or obligations secured by this Mortgage or otherwise. No sale of all or any of the Premises, no forbearance on the part of the Lender, no release or partial release of any of the Premises, and no extension, whether oral or in writing, of the time for the payment of the whole or any part of the Obligations or any other indulgence given by the Lender to the Mortgagor, shall operate to release or in any manner affect the lien of the Mortgage with respect to those portions of the Premises not released pursuant to Section 8.7 or the original liability of the Mortgagor, notice of any such extensions or indulgences being hereby waived by the Mortgagor. Any entering upon and taking and maintaining of control of the Premises by the Lender, the receiver or any agent thereof, and any application of rents as provided herein shall not cure or waive any default hereunder or invalidate any other right or remedy of the Lender under applicable law or provided herein.
