Common use of No Party Clause in Contracts

No Party. (other than the Security Agent) may take any proceedings against any officer, employee or agent of the Security Agent in respect of any claim it might have against the Security Agent or in respect of any act or omission of any kind by that officer, employee or agent in relation to any Secured Finance Document or this Agreement and any officer, employee or agent of the Security Agent may rely on this Clause 13.3.

No Party. (other than the Security Agent) may take any proceedings against any officer, employee or agent of the Security Agent in respect of any claim it might have against the Security Agent or in respect of any act or omission of any kind by that officer, employee or agent in relation to any Secured Senior Finance Document, any Hedging Document, any Interim Facility Finance Document, any Second Lien Notes Finance Documents, any Arco Notes Security Documents, any Equistar Notes Security Document, any High Yield Notes Finance Document or this Agreement and any officer, employee or agent of the Security Agent may rely on this Clause 13.3Clause.

No Party. (other than the Security Agent) may take any proceedings against any officer, employee or agent of the Security Agent in respect of any claim it might have against the Security Agent or in respect of any act or omission of any kind by that officer, employee or agent in relation to any Secured Finance Document Document, any Transaction Document, the Transaction Security or this Agreement and any officer, employee or agent of the Security Agent may rely on this Clause 13.3clause 17.8 as a stipulation for its benefit (stipulatio xxxxxx) open for acceptance by it at any time and in any manner permitted by law.

No Party. (other than the Agent or the Security AgentTrustee) may take any proceedings against any officer, employee or agent of the Agent or the Security Agent Trustee in respect of any claim it might have against the Agent or the Security Agent Trustee or in respect of any act or omission of any kind by that officer, employee or agent in relation to any Secured Finance Document or this Agreement and any officer, employee or agent of the Agent or the Security Agent Trustee may rely on this Clause 13.3subject to Clause 1.3 (Third Party Rights) and the provisions of the Third Parties Act.

No Party. (other than the Security Agent) may take any proceedings against any officer, employee or agent of the Security Agent in respect of any claim it might have against the Security Agent or in respect of any act or omission of any kind by that officer, employee or agent in relation to any Secured Finance Document or this Agreement Document; and any officer, employee or agent of the Security Agent may rely on this Clause 13.332 (The Security Agent) subject to Clause 1.3 (Third party rights) and the provisions of the Third Parties Act.
