Common use of No Merger Clause in Contracts

No Merger. The leaseback of the Project Site by the Developer to the District pursuant to the Facilities Lease shall not effect or result in a merger of the estates of the District in the Project Site, and the Developer shall continue to have a leasehold estate in the Project Site pursuant to this Site Lease throughout the term hereof.

No Merger. The leaseback of the completed Project and Site by the Developer to the District pursuant to the Facilities Lease shall not effect or result in a merger of the estates of the District in the Project Site, and the Developer shall continue to have a leasehold estate in the Project Site pursuant to this Site Lease throughout the term hereof.

No Merger. The leaseback of the Project Site Sites by the Developer to the District pursuant to the Master Facilities Lease shall not effect or result in a merger of the estates of the District in the Project SiteSites, and the Developer shall continue to have a leasehold estate in the Project Site Sites pursuant to this Master Site Lease throughout the term hereof.

The leaseback of the Project Site Site(s) by the Developer Contractor to the District pursuant to the Master Facilities Lease shall not effect or result in a merger of the estates of the District in the Project SiteSite(s), and the Developer Contractor shall continue to have a leasehold estate in the Project Site Site(s) pursuant to this Master Site Lease throughout the term hereof.

The leaseback of the Project Site by the Developer Contractor to the District pursuant to the Master Facilities Lease shall not effect or result in a merger of the estates of the District in the Project Site, and the Developer Contractor shall continue to have a leasehold estate in the Project Site pursuant to this Master Site Lease throughout the term hereof.

The leaseback of the Project Site Site(s) by the Developer Contractor to the District pursuant to the Facilities Lease shall not effect or result in a merger of the estates of the District in the Project SiteSite(s), and the Developer Contractor shall continue to have a leasehold estate in the Project Site Site(s) pursuant to this Site Lease throughout the term hereof.
