No Layoff. 26.1 For the Term of this Agreement, the Employer shall not lay off any of the Employees who are employed at the Facilities as of December 31st, 2004. Notwithstanding the foregoing, nothing herein restricts the Employer from hiring, reducing or laying off Employees exceeding the Employer's minimum Employee requirement, where the Employer determines in its sole discretion that it requires or does not require such Employees for the operation of the Facilities.
