Common use of No Implied Warranties Clause in Contracts

No Implied Warranties. Except as otherwise expressly provided in this Agreement, neither party makes any representation or warranty, whether express or implied, in connection with the subject matter of this Agreement and hereby disclaims any and all implied warranties, including: (i) of merchantability or fitness for a particular purpose regarding such subject matter; (ii) arising from the course of performance, course of dealing or usage of trade; or (iii) of noninfringement. Xxxxxxx.xxx provides the Xxxxxxx.xxx Platform and Xxxxxxx.xxx Service on an "as is" and "as available" basis. Partner provides the Partner Platform on an "as is" and "as available" basis.
