Common use of No GPL or Open Source Code Clause in Contracts

No GPL or Open Source Code. Licensor represents and warrants that the Licensor Software does not contain any code subject to the GNU General Public License (“GPL”), “copyleft” license, or any other license that requires as a condition of use, modification and/or distribution of such code that other software incorporated into, derived from or distributed with such code be (i) disclosed or distributed in Source Code form; (ii) licensed for the purpose of making Derivative Works; or (iii) redistributable at no charge. Licensor represents and warrants that the Documentation and Training Materials are not subject to the GNU Free Documentation License or other license that imposes any of the conditions listed above for code.
