Common use of No Deviation Clause in Contracts

No Deviation. If an alleged Deviation described in a Deficiency Report is found not to exist and if the alleged Deviation instead constitutes a change in the scope of the Deliverable, the party responsible for the Deliverable will notify the receiving party accordingly, and the receiving party can then initiate the Change Request procedure. If LLC and DBS disagree about the existence of a Deviation and the disagreement is not resolved by the respective Project Managers, either DBS or LLC can initiate the Problem Report procedure.
