No Condemnation Proceedings. Since January 1, 1995, no elections have been held or other actions taken authorizing the commencement of proceedings for condemnation of any of the properties of the Company. However, from time to time there are expressions of interest made by public bodies, elected or appointed municipal officials, persons seeking political position or citizens groups urging acquisition of the Company’s facilities in one or more of the communities served by the Company. The Company does not believe that any acquisition by a city or municipality of its properties by condemnation or threat thereof would be adverse to the holder of the Series O Notes.
No Condemnation Proceedings. There is no proceeding pending or threatened for the total or partial condemnation of such Mortgaged Property that would have a material adverse effect on the value, use or operation of the Mortgaged Property.
No Condemnation Proceedings. To Seller’s Knowledge, (a) the Property has not been condemned or conveyed by deed in lieu of condemnation, nor (b) are there now pending or threatened in writing condemnation or similar proceedings affecting the Property or any portion thereof.
No Condemnation Proceedings. To Seller's knowledge, there are no condemnation or eminent domain proceedings pending, threatened or contemplated against the Property or any part of the Property, and Seller has received no notice, oral or written, of the desire of any public authority or other entity to take or use the Property or any part of the Property.
No Condemnation Proceedings. There is no proceeding pending for the total or partial condemnation of the Mortgaged Property and such property is undamaged by waste, fire, earthquake or earth movement, windstorm, flood, tornado, or other casualty, or if damaged, then the Mortgaged Property is adequately insured therefor so as to affect adversely the value of the Mortgaged Property as security for the Mortgage Loan or the use for which the premises were intended.
No Condemnation Proceedings. There is no action, suit or proceeding (including any proceeding in condemnation or eminent domain or under any Environmental Law) pending or, to the knowledge of any Borrower or any other Guarantor, threatened which adversely affects the title to, or the use, operation or value of, the hotel and casino operations that are subject to the Debentures.
No Condemnation Proceedings. Neither the Property nor any interest in it shall be affected by eminent domain or condemnation proceedings.
No Condemnation Proceedings. As of the Closing Date through the Closing Date, Xxxxxx has received no written notice from any governmental authority having jurisdiction over the Property that the Property is presently the subject of any condemnation, assessment or similar proceeding or charge, and to Seller’s knowledge, no such condemnation, assessment, or similar proceeding or charge is currently threatened.
No Condemnation Proceedings. There are no condemnation proceedings or eminent domain proceedings of any kind pending or, to Sellers’ Knowledge, Threatened against the Owned Real Property or the Wilkesbarre Pier.
No Condemnation Proceedings. To the Knowledge of Seller, there is no proceeding pending or threatened for the total or partial condemnation of the Mortgaged Property or REO Property.
