Common use of No Collateral Attack Clause in Contracts

No Collateral Attack. This Agreement shall not be subject to collateral attack by any Class Member or any recipient of the Notice of Class Settlement after the Final Order and Dismissal is entered. Such prohibited collateral attacks shall include, but not be limited to, claims that a Class Member failed for any reason to receive timely notice of the procedure for submitting a Claim Form.

No Collateral Attack. This Agreement shall not be subject to collateral attack by any Class Member at any time on or any recipient of the Notice of Class Settlement after the Final Order and Dismissal is enteredEffective Date. Such prohibited collateral attacks shall include, include but not be limited to, to claims that a the Settlement Class Member failed for any reason to receive timely notice of the procedure for submitting a Claim Formclaim.
