Common use of No Collateral Attack Clause in Contracts

No Collateral Attack. This Settlement Agreement shall not be subject to collateral attack by any Settlement Class Members or their representatives any time on or after the Effective Date. Such prohibited collateral attacks shall include, but shall not be limited to, claims that a Settlement Class Member’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim was improperly denied, that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed to receive timely notice of the Settlement.

No Collateral Attack. This Settlement Agreement shall not be subject to collateral attack by any Settlement Class Members Member or their representatives any time on or recipient of the notices to the Settlement Class after the Effective Datejudgment and dismissal is entered. Such prohibited collateral attacks shall include, but shall not be limited to, include claims that a Settlement Class Member’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim Award was improperly denied, calculated or adjusted or that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed to receive timely notice of the Settlementprocedure for disputing the calculation of the individual Settlement Award or failed to submit a timely dispute letter for any reason.

No Collateral Attack. 17 This Settlement Agreement shall not be subject to collateral attack by any Settlement Class Members or their representatives 18 Member at any time on or after the Effective Date. Such prohibited collateral attacks shall include, 19 but shall not be limited to, claims that a Settlement Class Member’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim was improperly denied, 20 that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement 21 Class Member failed to receive timely notice of the SettlementSettlement Agreement.

Such prohibited collateral attacks shall include, include but shall not be limited to, to claims that a Settlement Class Member’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim was improperly denied, that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed for any reason to receive timely notice of the Settlementprocedure for disputing the calculation of her or his Individual Settlement Shares.

Such prohibited collateral attacks shall include, but shall not be limited to, claims that a Settlement Class MemberReleasing Party’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim was improperly denied, that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed to receive timely notice of the Settlement.

Such prohibited Prohibited collateral attacks shall include, but shall are not be limited to, claims assertions that a Settlement Class Member’s claim should have been heard or decided by another court or in another suitforum, that a Settlement Class Member’s claim was improperly denied, that the payment to a Settlement Class Member was improperly calculated, and/or or that a Settlement Class Member failed to receive timely notice of the SettlementMember’s request for exclusion was improperly denied.

Such prohibited collateral attacks shall include, but shall not be limited to, claims that a Settlement Class Member’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim was improperly denied, that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed to receive timely notice of the Settlement.

Such prohibited collateral attacks shall include, but shall not be limited to, claims that a Settlement Class Member’s claim should have been heard or decided by another court or in another suit, that a Settlement Class Member’s claim was improperly denied, that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed to receive timely notice of the Settlement.

No Collateral Attack. This Settlement Agreement shall not be subject to collateral attack by any Settlement Class Members Member or their representatives any time on or recipient of the Class Notice after the Effective DateJudgment and Dismissal is entered. Such prohibited collateral attacks shall include, but shall not be limited to, include claims that a Settlement Disclosure Class Member’s claim should have been heard or decided by another court or in another suit, that and/or a Settlement Pre-Adverse Class Member’s claim Settlement Amount was improperly deniedcalculated or adjusted, or that the payment to a Settlement Class Member was improperly calculated, and/or that a Settlement Class Member failed to timely receive timely notice Class Notice, or for any other related reasons. All Class Members shall be enjoined from pursuing and/or seeking to reopen claims of any type based upon the Settlementconduct alleged in the Complaint and released herein.
