Common use of Night rate Clause in Contracts

Night rate. (a) An employee whose normal hours of duty fall between 8.00pm and 6.00am from midnight Sunday/Monday to midnight Friday/Saturday will be paid at time and a quarter (T1.25) the ordinary hourly rate for all hours between 8.00pm and 6.00am. (b) Night rate is not to be paid when overtime is being worked. Night rate will not be paid for work undertaken on a public holiday which attracts other penal rates.

Night rate. (a) An employee whose normal hours of duty fall between 8.00pm 8pm and 6.00am from midnight Sunday/Monday to midnight Friday/Saturday 6am will be paid at time and a quarter (T1.25) the ordinary hourly ¼ rate in addition to normal salary for all hours which so fall, provided that the minimum payment under this provision shall not be less than payment for two hours at time ¼ rate even if the part of a shift which falls between 8.00pm the hours of 8pm and 6.00am. (b) 6am is less than two hours; Night rate is not to be paid when for the same hours as either overtime is being worked. Night rate will not be paid for work undertaken on a public holiday which attracts other or penal rates.
