Newly Created Positions a. Prior to the posting of a newly created position covered under the terms of this Agreement the parties shall negotiate the allowance for the position.

Newly Created Positions. A newly created position is one in a teaching/ service/ special program area which does not currently exist in the District. This newly created position may evolve when special needs arise. Any District personnel proposing a newly created position shall submit a proposal that identifies the tentative duties, responsibilities and qualifications for the newly created position to the Assistant Superintendent for Human Resources who, if the position is authorized, will contact the CTA President to invoke the process specified in this agreement for creating the necessary job description after the job description has been written. The Assistant Superintendent for Human Resources and the CTA President shall reach agreement on the classification of the newly created position in one of the following categories:
Newly Created Positions. If the District creates any new classification with the bargaining unit during the term of the Agreement, it shall negotiate with the Federation to determine and establish the salary rate, job title and working conditions for the balance of the term of the Agreement. Such a wage determination by the District shall not be subject to Article V -
Newly Created Positions. If the District creates any new classifications within the bargaining unit during the term of the Agreement, it shall determine and establish the salary rate and rules applicable thereto for the balance of the term of the Agreement. It shall notify the Association of any such action. Such a wage determination by the District shall be subject to the grievance and arbitration procedures of Article V, but only upon grounds that the District acted arbitrarily, capriciously or vindictively.
Newly Created Positions. The compensation for any newly-created extracurricular positions set forth in Schedule B shall be subject to negotiations between the Board and the Association.

Newly Created Positions. All newly created positions, except those that are lawfully certificated, management, confidential, or supervisory employees shall be assigned to the bargaining unit. The determination of management, confidential or supervisory employees shall be made by the District. In cases where the Association disagrees, such cases shall be submitted to the Public Employment Relations Board (PERB) for resolution.
Newly Created Positions. Newly created positions within the Bargaining Unit shall be filled according to Article VIII, Sec. 2 if such position meets the need to be considered a specialized position. The Employer and Union will discuss the terms and conditions of any newly created positions.
Newly Created Positions. In the case of newly created jobs, job descriptions shall be written by the Department Head/Manager. Such job description shall be reviewed by the Employee Relations Manager and a copy provided to the Union prior to submission to the CUPE Local 1393 Joint Job Evaluation Committee. Such position will be evaluated by the JJEC and a classification established as being one of the classifications set forth in Schedule "A" of the within contractual agreement. If a tentative classification was rendered, it is further agreed that any salary changes which may be necessitated by reason of upward evaluation shall be retroactive to the employee’s start date in that position. In the case of newly created jobs, the Employer or the Union may appeal the initial decision of the JJEC. The result of the appeal shall be final and binding until the Employee has been in the position for twelve (12) months.
