Newly Created Position. In the event a new position is created within the scope of the bargaining unit positions, as defined in Article I – Recognition of the Agreement, the Superintendent shall first advise the Association President of the intent to create a new position and provide a copy of the job description. The wages, hours, terms and other conditions of employment for the new position will be governed by this collective bargaining agreement.
Newly Created Position. A specific certificated position that has not previously existed in the Butte County Office of Education.
Newly Created Position. If the Sheriff’s Office creates a new position which may be eligible for inclusion within a Bargaining Unit under Chapter 4117 of the Ohio Revised Code, the Sheriff’s Office and the Union shall meet to determine the appropriate Bargaining Unit, if any, for the new position. If an agreement can not be reached, the parties shall jointly request the State Employment Relations Board to resolve this issue.
Newly Created Position. A newly created position may be filled on a temporary basis for thirty (30) consecutive work days. The newly created position will be deemed to be of a permanent nature after thirty (30) consecutive work days and the job posting procedure as outlined in Article 12 will be followed.

(a) In the event the Employer creates a new Job Classification in the Fire Department, employees shall be given the opportunity to transfer on the basis of seniority and qualifications. In such case, the newly created Job Classification shall be posted within the Department for seven (7) calendar days.

Should the Board create a new position to be filled by a Teacher who would come under this collective agreement, the parties shall negotiate and reach an agreement on the annual salary and allowances, if any, the duties, responsibilities, qualifications and other circumstances affecting the filling of the position, before an appointment is made. If no agreement is reached, the matter may be submitted to arbitration. The annual salary and allowances, if any, shall be payable from the effective date of the appointment.
