Common use of New Technology Clause in Contracts

New Technology. Contractor and the County acknowledge the probability that the technology of the software and hardware which comprise the System will change and improve during the Term of this Contract. The County desires the flexibility to incorporate into the System any new technologies as they may become available. Accordingly, Contractor’s Project Manager must, promptly upon discovery and on a continuing basis, apprise County’s Project Director of all new technologies, methodologies, and techniques which Contractor considers to be applicable to the System. Specifically, upon County’s request, Contractor must provide, in writing, a description of such new technologies, methodologies and techniques, indicating the advantages and disadvantages of incorporating same into the System, and provide an estimate of the impact such incorporation will have on the performance, scheduling and price of the System. County, at its sole discretion, may request that this Contract be amended to incorporate the new technologies, methodologies, and techniques into the System.
