NEW TECHNOLOGIES NOT IN DEVELOPMENT. Buyer will not be entitled under this Supply Agreement to purchase Wafers manufactured and Services provided through the use of Process Technologies that are not not developed or qualified for full-scale production at the Supplier Fab as of the Effective Date. Supplier and Buyer may mutually agree on the terms and conditions of the development of such Process Technologies and the supply of Wafers and Services by Supplier to Buyer utilized such Process Technologies in a separate agreement.
