NETWORK OPERATIONAL PHASE Clause Samples

The "Network Operational Phase" clause defines the period during which a network is fully functional and actively providing its intended services. This clause typically outlines the criteria for when the operational phase begins, such as successful completion of testing or commissioning, and may specify the responsibilities of the parties for maintenance, monitoring, and performance during this time. Its core practical function is to clearly delineate the transition from network construction or setup to ongoing operations, ensuring both parties understand their obligations and the standards expected during the network's active use.
NETWORK OPERATIONAL PHASE. Without undue delay after successful completion of the Compliance Check process and in line with the Implementation Plan, the Network Service Provider shall make available the Network and the Connectivity Services in all environments of the ESMIG Services in a manner which allows the Eurosystem and the Di.Co.A. to use the Network and the Connectivity Services for their respective ESMIG Services testing and production activities. For purposes of this Contract, the "Network Operational Phase" of the Network and the Connectivity Services shall be the period commencing on the date on which the Eurosystem has notified the Network Service Provider of the successful completion of the Compliance Check and shall end upon the expiration or termination of this Contract.
