Expansive controls will only be used when the Parties mutually agree.\n8.2.4 The Parties shall cooperate and share pre-planning information regarding cross-network call-ins expected to generate large or focused temporary increases in call volumes, in order to prevent or mitigate the impact of these events on the public switched network.\n8.2.5 Carrier shall acknowledge calls in accordance with the following protocols.\n8.2.5.1 Carrier will provide a voice intercept announcement or distinctive tone signals to the calling party when a call is directed to a number that is not assigned by Carrier.\n8.2.5.2 Carrier will provide a voice announcement or distinctive tone signals to the calling party when a call has been received and accepted by Carrier's MSC.\n8.2.5.3 Carrier and SBC-13STATE will work cooperatively to install and maintain a reliable network. Carrier and SBC-13STATE will exchange appropriate information (e.g., maintenance contact numbers, network information, information required to comply with law enforcement and other security agencies of the government and such other information as the Parties shall mutually agree) to achieve this desired reliability.\n8.2.6 When Carrier's MSC is not able to complete calls because of a malfunction in the MSC or other equipment, Carrier will either divert the call to its operator, or provide a recorded announcement to the calling party advising that the call cannot be completed.\n8.2.7 Carrier will provide supervisory tones or voice announcements to the calling party on all calls, consistent with standard telephone industry practices.\n8.2.8 Neither Party will use any service provided under this Agreement in a manner that interferes with third parties in the use of their service, prevents third parties from using their service, impairs the quality of service to other carriers or to either Party's End User Customers. Either Party will provide the other Party immediate notice of said impairment.\n8.2.9 The characteristics and methods of operation of any circuits, facilities or equipment of either Party or that of a third party in conjunction with either Party's facilities, shall not materially interfere with or impair service over any facilities of the other Party, its Affiliate companies or its connecting and concurring carriers involved in its services, cause damage to their plant, impair the privacy of any communications carrier over their facilities or create electrical hazards to the employees of any of them or the public, or malfunction of either Party\u2019s billing equipment. If either Party causes an Impairment of Service, as set forth in this Section, the Party whose network or service is being impaired (the \u201cImpaired Party\u201d) shall promptly notify the Party causing the Impairment of Service (the \u201cImpairing Party\") of the nature and location of the problem. The Impaired Party shall advise the Impairing Party that, unless promptly rectified, a temporary discontinuance of the use of any circuit, facility or equipment may be required. The Impairing Party and the Impaired Party agree to work together to attempt to promptly resolve the Impairment of Service.
