Common use of Net Clause in Contracts

Net. Upon the execution and delivery of this Agreement, the Merxxx xxxx be submitted to the shareholders of P.E.T.Net for approval. Upon approval of the Merger by the shareholdexx xx X.X.T.Net as provided in SECTION 6, Merger Corp and P.E.T.Net will prxxxxx, xxecute and file (i) Articles of Merger under xxx Xxxxessee Corporation Act in the form attached hereto as EXHIBIT B, to be filed with the Secretary of State of the State of Tennessee; (ii) and the Plan of Mercer to be attached to and filed with the said Articles of Merger. The Merger shall be effective upon the filing of such Articles of Merger with the Secretary of State of the State of Tennessee, or at such time thereafter as may be provided in the said Articles of Merger (the "Effective Date").
