Net Selling Price of a Product means the total sales revenue for such Product (including any amounts for rental or leasing of such product), excluding charges for returns, rebates, credits, post-sale adjustments, including adjustments for doubtful accounts, outbound prepaid or allowed transportation charges, sales taxes, tariffs or duties directly imposed with reference to particular sales or similar items.

Net Selling Price. Net Selling Price" shall mean the invoiced price, F.O.B. Atmel's factory, to its customer, less any quantity and trade discounts, independent sales representative or independent distributor commissions, and/or product returns, and excluding charges for handling, freight, taxes or duties of any kind, C.O.D. charges, insurance, and the like.
Net Selling Price. The term "Net Selling Price" means: (a) the actual net amount received by NGCSI, or a commercial manufacturing licensee of NGVSI (other than a research and development licensee), for Technology Products sold to any third party less any amount actually paid or credited by NGVSI for any Technology Products returned for refund; and (b) the net price at which Technology Products are being sold or offered for sale in similar quality and quantity on the date when such Technology Products are delivered for use by either NGVSI or a licensee thereof under circumstances where NGVSI or such licensee are the end users of such Technology Products.

Net Selling Price. The per gallon price Producer shall receive for the Ethanol sold to GPTG under this Agreement shall be the Net Selling Price (as that term is defined below). The term "Net Selling Price" means GPTG's per gallon contract selling price for the Ethanol in question, which shall be the price set forth in the Purchase Order presented to Producer pursuant to Section 5.B above, less all direct costs (on a per gallon basis) incurred by GPTG in conjunction with the handling, movement, delivery and shipment of such Ethanol from GPTG to the original purchaser, including but not limited to terminal lease charges, throughput charges, terminal shrinkage costs, freight charges, tariffs, costs of leasing railcars, trucks, river barges and ocean going vessels (all at cost), government taxes and assessments, insurance, inspection fees, working capital carrying costs, costs associated with RINS management, and costs of purchasing and delivering replacement ethanol in the event of Producer's failure to provide Ethanol in accordance with an Accepted Purchase Order, including any such failure caused by any Impossibility Event or for any other reason.
Net Selling Price. The actual end-user price for Product provided to a Customer, less sales taxes, cost of shipping insurance, cost of freight, cost of packing, and other transportation charges, but only if such taxes, costs and charges are expressly stated and separately invoiced or may be readily determined by acceptable accounting practices.
Net Selling Price. The term "Net Selling Price," as used herein, means the gross invoice price of Licensed Products sold or used separately or as part of a larger system, less the sum of the following deductions where applicable: cash, trade or quantity discounts, if any; sales, use, tariff, import/export duties or other excise taxes imposed upon particular sales; transportation charges; and allowances or credits to customers because of rejections or returns.

Net Selling Price. In the event that the iNSECT PSA ICs are sold or disposed of in circumstances in which the selling price is established on other than an arms-length basis, Net Sales shall be deemed to be the volume of such iNSECT PSA ICs multiplied by the average net selling price "Net Selling Price" (where "net" is consistent with definition of Net Sales) earned by THLC during such quarter on Sales of the same iNSECT PSA IC (if there is no such sale of the same iNSECT PSA IC, then those of similar iNSECT PSA IC) to other customers in arms-length Sales.
