Negotiated Rates. At any time during the third quarter of Contract Year 3, if the Parties have not adopted *, ACC may (but shall not be obligated to) initiate, by notice to AWS, a 30-day period of roaming rate and exclusivity negotiations, provided, that such 30-day period must be commenced and completed within the third quarter of Contract Year 3. If negotiations are initiated by ACC, both Parties will negotiate in good faith to seek to agree on fair and reasonable GSM and GPRS roaming rates and exclusivity provisions for Contract Years 4 and 5.
Negotiated Rates. (a) Negotiated Monthly Base Reservation Rate(s): $13.6875/Dth. of MDQ (b) Negotiated Base Commodity Rate(s): $.0049/Dth.
Negotiated Rates. Notwithstanding anything to the contrary contained in this Tariff, Transporter and Shipper may, as provided in § 27 of the General Terms and Conditions, negotiate a rate for service under this Rate Schedule. Transporter's rates, as shown on its Statement of Rates, are available as recourse rates for any Shipper that does not desire to negotiate a rate with Transporter. An agreement by the Shipper to accept a Negotiated Rate does not, in any manner, restrict the Shipper's right to elect recourse rates for other services not covered by the negotiated-rate agreement. This provision, in and of itself, does not allow Transporter and Shipper to negotiate terms and conditions of service.
Negotiated Rates. The MANAGER shall have the right to negotiate CENTER rental rates that may differ from the approved CENTER rate schedule for certain events in order to maximize use of the CENTER and improve the economic impact for the CENTER and the City of Natchitoches. All such variations will be consistent with policies established. A TTORNEY’S FEES: In the event CLIENT breaches this AGREEMENT, CLIENT shall be responsible for the attorney’s fees of CENTER and MANAGER.
Negotiated Rates. Notwithstanding any provision of GTN's Tariff to the contrary, GTN and Shipper may mutually agree in writing to a Negotiated Rate (including a Negotiated Rate Formula) with respect to the rates, rate components, charges, or credits that are otherwise prescribed, required, established, or imposed by this Rate Schedule or by any other applicable provision of GTN's Tariff. Such Negotiated Rate shall be set forth in Attachment B to the Firm Transportation Service Agreement and GTN shall make any filings with the Commission necessary to effectuate such Negotiated Rate. Negotiated Rates. The Parties mutually acknowledge that the rates, terms, and conditions for transport and termination of Reciprocal Compensation Traffic, Information Access Traffic and Transit Traffic specified in Section 4.0, are voluntarily negotiated rates, pursuant to Section 252(a)(1) of the Act, and may differ from the rates that would be imposed by a regulatory agency under Section 252(d)(2) of the Act. Accordingly, a regulatory determination that CTCO’s costs of transport and termination are either higher or lower than the rates agreed to, shall not constitute an event requiring negotiation under Section 11.1 of the Agreement. Likewise, a Law requiring the use of a particular type of compensation arrangement or particular rates to be compensated for the transport and termination of traffic within the scope of this Agreement shall not constitute an event requiring negotiation under Section 11.1, unless the Law expressly requires changes to agreements entered into before the effective date of the Law. To the extent a Law expressly requires a change to a rate then the rate will be renegotiated.
Negotiated Rates. If the Indian Health Care Provider (IHCP) can negotiate such agreements with third party providers, the Indian Health Care Provider (IHCP) may pay third party providers less than Medicaid fee-for-service rates.
Negotiated Rates. Payment for subsidized child care services shall be based upon the School Readiness Negotiated Rate Sheets attached here to as Attachment “A” and Attachment “B” which are expressly made a part hereof and incorporated by reference herein. In no event will the Provider be reimbursed at a rate that exceeds the lower of the maximum reimbursement rate designated by the Coalition, or the Provider’s maximum private pay rate. Increases in the reimbursement rate will be effective, as applicable, the first of the month following notification in writing by the provider to Family Central, Inc.
