Negotiated Rate. The amount negotiated for the engagement of the Director or the Second Unit Director as shown in the Contract, which may not be lower than the minimum rates set out in this Agreement.
Negotiated Rate. The term “Negotiated Rate” shall mean a rate or rate formula for computing a rate for service under a single rate schedule under which, for some portion of the contract term, one or more of the individual rate components may exceed the maximum charge, or be less than the minimum charge, for such component of the applicable tariff rate as set forth in Transporter’s Schedule of Rates. A Negotiated Rate must be mutually agreed upon by Transporter and Shipper, and may be based on a rate design other than straight fixed-variable.

Negotiated Rate. The Commission’s Negotiated Rate Policy Statement requires that pipelines provide “a detailed narrative outlining the terms of its negotiated contract, the manner in which such terms differ from its form of service agreement…”.3 In accordance with this directive and pursuant to Section 46 of the GTC of Columbia’s Tariff, Columbia informs the Commission that Columbia and Eclipse Resources Marketing, LP (“Eclipse”) have agreed to the following negotiated rate:
Negotiated Rate. For facilitation services rendered the County shall pay the sum of up to $2,500.00 per month during the contract period. Negotiated Rate. The term "Negotiated Rate" shall mean a rate provision under which Horizon and Shipper have agreed on the amount to be charged for the service under Rate Schedule FTS or ITS which results in a rate where, for all or a portion of the contract term, one or more of the individual components of such rate exceeds or may exceed the applicable maximum rate or is less than or may be less than the applicable minimum rate. Any Agreement entered into which provides for a rate under Rate Schedule FTS or ITS other than the applicable maximum rate shall contain a provision setting out the mutual agreement of the parties, consistent with Commission policy, as to whether the pricing terms represent a discounted rate or a Negotiated Rate.
Negotiated Rate. This Contract will be based upon the Contractor’s submitted Bid Schedule. The contract amount will not exceed TBD. The total dollar amount of the Contract as specified herein may only be modified by written agreement of both parties to the Contract in the form of a Contract Amendment as specified in Article14 below.
