Negligible. An error which is an operator inconvenience or annoyance and produces minor operational inconsistencies but does not affect a required operational or mission essential function. Minor or Negligible Failures shall not give the right of rejection by Customer. Such failures shall be stated in the SAT reports and shall be rectified under Supplier' warranty obligations. Critical or Major Failures shall be corrected by Supplier at its expense before the SAT is considered successful, unless otherwise agreed by the Parties in writing.

Negligible. The impact is the lowest level of detection. Minor – The impact is slight, but detectable. Moderate – The impact is readily apparent. Major – The impact is a severe or adverse impact or of exceptional benefit. Because all known mitigating measures have been included in the descriptions of the Proposed Action, the environmental consequences described below are unavoidable.

  • Excessive absenteeism The parties recognize that every employee has a duty to be reliably present at work, and that failure to confine sick leave usage to accrued and available sick leave raises the possibility of discipline for excessive absenteeism. Remanufactured parts or components meeting new Product standards may be permitted by the Commissioner or Authorized User. Before installation, all proposed substitutes for the original manufacturers’ installed parts or components must be approved by the Authorized User. The part or component shall be equal to or of better quality than the original part or component being replaced.

  • SHRINKAGE Seller will retain 3% of all volumes delivered to Seller on Xxxxx's behalf for shrinkage and line losses. The volumes retained by Seller will not create or contribute to an imbalance. Seller reserves the right to adjust the shrinkage factor, up or down, to account for actual line losses. Xxxxxx agrees to give Buyer thirty (30) days written notice of any adjustment.

  • COUNTERFEIT GOODS a. Seller shall not furnish Counterfeit Goods to Buyer, defined as Goods or separately-identifiable items or components of Goods that: (i) are an unauthorized copy or substitute of an Original Equipment Manufacturer or Original Component Manufacturer (collectively, “OEM”) item; (ii) are not traceable to an OEM sufficient to ensure authenticity in OEM design and manufacture; (iii) do not contain proper external or internal materials or components required by the OEM or are not constructed in accordance with OEM design; (iv) have been re- worked, re-marked, re-labeled, repaired, refurbished, or otherwise modified from OEM design but not disclosed as such or are represented as OEM authentic or new; or (v) have not passed successfully all OEM required testing, verification, screening, and quality control processes. Notwithstanding the foregoing, Goods or items that contain modifications, repairs, re-work, or re-marking as a result of Seller’s or its subcontractor’s design authority, material review procedures, quality control processes or parts management plans, and that have not been misrepresented or mismarked without legal right to do so, shall not be deemed Counterfeit Goods. Counterfeit Goods shall be deemed nonconforming to this Contract.

  • Drugs Possession or use of drugs by the Student, any person present in the residence with the Student, or any person present in the Student’s residence with the permission of the Student during the Student’s absence, are strictly prohibited in any UCF DHRL facility.
