Common use of MOVE-IN CONDITION Clause in Contracts

MOVE-IN CONDITION. EBI has inspected and accepts the Property AS IS except for conditions materially affecting the safety or health of ordinary persons or unless expressly noted otherwise in this Agreement. The Company has made no express or implied warranties about the condition of the Property and no agreements have been made about future repairs unless specified in this Agreement. EBI is required to fill out the acceptance checklist and accurately record the condition of the Property within forty-eight (48) hours after the Commencement Date of this Agreement. EBI’s failure to timely deliver the online checklist will be deemed as EBI’s acceptance of the Property in a clean and good condition, with no defects or damage. No such document is a request for maintenance or repairs. EBI will direct all requests for repairs in accordance with Section 19.
