Carrier shall have the right to protest any new or additional taxes imposed on the Leased Fiber during the Lease Term.

Monthly Lease Payments. Lessee agrees to pay in advance to Lessor each month during the term of this Agreement the payment (a "Monthly Lease Payment") set forth in Exhibit B hereto. The Monthly Lease Payments shall be adjusted upon the second anniversary of this Agreement and on each second anniversary thereafter in connection with increases in the Consumer Price Index as set forth in Exhibit X. Xxxxxx'x invoices for amounts payable hereunder shall be due upon receipt by Lessee. In the event that any Monthly Lease Payment remains unpaid after thirty (30) days following the date of the first Lessor invoice for such payment, such payment shall be subject to a late payment charge equal to the lesser of (i) one and one-half percent of the unpaid balance per month or (ii) the maximum rate allowed under applicable state law. Lessor shall send invoices to Lessee at the address listed herein. Monthly rental payments shall commence upon completion of Lessor equipment installation.

The nameplate capacity of the Sys- tem may change in size based on Customer’s needs during the Term of this Agreement as stated in section 1.1. Unless other option is provided by Provider and exercised by Customer in writing, Cus- tomer will return the System at the end of the Agreement Term and, if Customer fails to provide access to the System for recovery, will pay an equivalent daily charge based on the applicable monthly lease payment for any time after the Termination Date until Provider recovers the System. In the event that the Customer seeks Provider’s concurrence to relocate the System to a new Service Territory, Customer agrees that monthly lease payments will be adjusted to either (i) the applicable lease terms for the new Service Territory that were in effect at the date the Agreement was accepted by Provider or (ii) in the event that a Lease Program was not established in the new service territory at the time the Agreement was accepted, then the earliest applicable lease terms available.   • Monthly Base Rent On each Due Date, each Lessee shall pay to the Lessor the Monthly Base Rents that have accrued during the Related Month with respect to all Vehicles that were leased by such Lessee under this Operating Lease on any day during the Related Month;

All rentals payable under the terms of this Lease shall be paid by the Lessee to the trustee (the “Trustee”) under the trust indenture (the “Indenture”) securing the bonds to be issued by the Lessor to provide funds for the project on the Premises (such bonds, or bonds issued to refund such bonds, the “Bonds”). All payments so made by the Lessee shall be considered as payments to the Lessor of the rentals payable hereunder. After the sale of the Bonds, the annual rental shall be reduced to the multiple of $1,000 next higher than the principal and interest due in each twelve (12) month period commencing each year on June 30 payable in semi‑annual installments together with an amount sufficient to cover annual trustee fees and other administrative costs but not to exceed Five Thousand Dollars ($5,000). In addition, each such reduced semi-annual installment shall be based on the value of the portion of the Premises which is complete and ready for use and occupancy by the Lessee at the time such semi-annual installment is made. Such amount of adjusted rental shall be endorsed on this Lease at the end hereof in substantially the form of Exhibit B attached hereto by the parties hereto as soon as the same can be done after the sale of the Bonds, and such endorsement shall be recorded as an addendum to this Lease. The fixed annual rentals described in this Section 2 (the “Fixed Annual Rentals”) and the additional rentals described in Section 3 (the “Additional Rentals”) shall be payable solely from the budgeted revenues of the Lessee (the “Budgeted Revenues”). The Lessee may pay the Fixed Annual Rentals and the Additional Rentals or any other amounts due hereunder from any other revenues legally available to the Lessee; provided, however, the Lessee shall be under no obligation to pay any Fixed Annual Rentals or Additional Rentals or any other amounts due hereunder from any moneys or properties of the Lessee except the Budgeted Revenues received by the Lessee.
