Common use of Monitoring and Evaluation Methodology Clause in Contracts

Monitoring and Evaluation Methodology. 1. By execution of this contract, the sub-recipient hereby acknowledges and agrees that its performance under the contract must meet the standards set forth in this contract and will be bound by its conditions. If the sub-recipient fails to meet the terms of this contract, the Coalition will notify the sub-recipient in writing of the specific performance failures and may require the sub- recipient to respond to the performance failures by developing a corrective action plan that is mutually agreed upon by the Coalition and sub-recipient. In the event a mutual agreement cannot be reached, the Coalition will have final determination of the corrective action plan requiring conformance with the contract. If the sub-recipient fails to achieve compliance with the corrective action plan, the Coalition has the authority to terminate the contract for cause in the absence of any extenuating or mitigating circumstances. The determination of extenuating or mitigating circumstances is the exclusive determination of the Coalition.
