Modern Award. Consistent with s.57 of the Act, the General Retail Industry Award 2010 is displaced in its entirety by this Agreement except where clauses are explicitly incorporated by this Agreement.
Modern Award. (a) Subject to subclause (b) and (c), and (d) this Agreement incorporates the Manufacturing and Associated Industries and Occupations Award 2020 as varied from time to time. (b) In incorporating the Award terms into this Agreement, they are to be read as altered to incorporate necessary changes resulting from them being provisions of an Agreement rather than provisions of the Award. For example, the words "this Award" would become "this Agreement". (c) Where there is any inconsistency between the terms of this Agreement and the terms of the Award being incorporated into this Agreement, this Agreement will take precedence to the extent of any inconsistency. (d) Notwithstanding any other provision in this clause, nothing in this clause incorporates any term dealing with Long Service Leave or Superannuation. (e) For the remainder of this document, subclauses (a), (b) and (c) above will be referred to as the "Incorporated Terms".
Modern Award. In addition to this Contract, your employment will be regulated by the [Insert Award] (‘Award’), however, the Award is not incorporated into, and does not form part of, this Contract.
Modern Award a) This Agreement operates to the exclusion of any modern or other award, including the Manufacturing and Associated Industries and Occupations Award 2010 as amended from time to time. b) However, no employee will be disadvantaged in terms of yearly salary (averaged) by the operation of this Agreement. The Company guarantees that over a twelve-month period, no individual will be financially disadvantaged in total remuneration when what they have earned under this Agreement is compared with what they would have earned under a wage based on the Award.
Modern Award. 5.1 For Employees who would otherwise, but for the operation of this Agreement, be covered by the Award, all the terms and conditions of the Award will apply to the relevant Employees according to the work being performed, save that the rates of pay applicable to the Employees must be at least 1% higher than those in the Award at all times during the life of this Agreement. 5.2 All rates of pay will be escalated in line with the National Wage Determination such escalation to take effect on 1 July each year provided however that the rates of pay will be further escalated on 1 July each year to ensure that each employee is always 1% above the Award rate at all times. 5.3 Should there be any inconsistency between the terms and conditions of this Agreement and the terms and conditions of the Award, the terms and conditions of this Agreement will prevail to the extent of the inconsistency.
